Terms of Service

1. Acceptance of Terms
By accessing this website and booking services through RealShots.ca, you agree to be bound by these Terms of Service, all applicable laws, and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Services Provided
We provide professional architectural and real estate photography services, including but not limited to:

High-end interior and exterior still photography.

iGuide virtual tours and floor plans.

Flash-based photography to ensure accurate color representation.

We do not offer HDR-processed photography, and our workflows are designed to maintain natural detail without the use of “window pull” editing techniques.

3. Intellectual Property and Licensing
Ownership: All photographs, virtual tours, and digital assets remain the sole intellectual property of the photographer.

Usage License: Upon full payment, the client is granted a non-exclusive, non-transferable license to use the images for the marketing of the specific property shot (e.g., MLS listing, personal website, social media).

Prohibitions: Images may not be sold, leased, or gifted to third parties (such as stagers, builders, or other realtors) without prior written consent and potential additional licensing fees.

4. Client Responsibilities
The client is responsible for ensuring the property is “camera-ready” at the scheduled time. This includes:

General cleaning and decluttering.

Ensuring all lights are functional and turned on.

Ensuring pets and occupants are not in the frame during the shoot.

Providing access to the property (lockbox codes, concierge, etc.).

5. Payment and Cancellation
Payment: Invoices are due upon receipt of the digital proofs or as otherwise specified in the project agreement.

Cancellations: Cancellations made within 24 hours of the scheduled shoot may be subject to a cancellation fee.

Weather: In the event of inclement weather that prevents exterior photography, we will work with you to reschedule the exterior portion of the shoot at the earliest convenience.

6. Limitation of Liability
The photographer shall not be liable for any indirect, incidental, or consequential damages resulting from the use of the services provided. Our total liability for any claim arising out of the services shall not exceed the total amount paid for those services.

7. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the Province of Ontario, Canada. Any disputes shall be subject to the exclusive jurisdiction of the courts in London, Ontario.
